What is a bed and breakfast?
Article L 324-3 of the Tourism Code defines bed and breakfast as rooms furnished in the home of the inhabitant with a view to welcoming tourists, in return for payment, for one or more nights, accompanied by services:
- The guest room(s) must be located in the inhabitant's house or flat.
- The rental of a guest room includes the provision of one night's accommodation and breakfast
- The host is responsible for the reception.
- He cannot rent more than 5 rooms per house, nor welcome more than 15 people at the same time.
- Each guest room has access (directly or indirectly) to a shower room and a toilet. It must comply with health, safety and sanitation regulations.
- The rental includes, as a minimum, the provision of linen and breakfast.
The Law for a Digital Republic of 7 October 2016 concerns furnished tourist accommodation and not bed and breakfast accommodation. Nevertheless, according to Article L. 324-4 of the Tourism Code, any person who offers one or more guest rooms for rent must first make a declaration to the mayor of the municipality of the place of residence concerned, on pain of a 3rd class fine (Article L. 324-16 of the same Code). This is done by means of CERFA n° 13566*02. From 1 November 2018, this is done via the Déclaloc teleservice.
